1. Introduction

Welcome to Balance 7 ("the App"), a wellness tracking application operated by Balance 7 Days ("we", "us", or "our"). By creating an account or using the App, you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 13 years of age to use the App. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the App, you represent and warrant that you meet these eligibility requirements.

3. Account Registration

To use the App, you must create an account by providing your first name, last name, email address, phone number, and a password. You may also provide an optional referral code. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to provide accurate and complete information during registration and to keep this information up to date.

4. Data Collection & Usage

The App collects and processes the following types of data to provide our wellness tracking services:

• Health Metrics: Exercise activity, sleep patterns, weight measurements, mood ratings, nutrition logs, screen time, reading habits, and inner child activity tracking.
• Voice Data: Audio recordings you create during daily check-ins (see Section 5 for details).
• Apple Health Data: With your permission, we read exercise, sleep, and weight data from Apple HealthKit (see Section 6 for details).
• Profile Information: Name, email, phone number, date of birth, sex, height, weight, exercise frequency, and journaling habits.
• Profile Photos: Images you upload for your profile.
• Usage Data: Your interactions with the App including daily entries, weekly scores, and goal progress.

We use this data to provide personalized wellness insights, generate weekly scores, and improve our services. We do not sell your personal data to third parties.

5. Voice Recordings & AI Processing

The App allows you to record voice check-ins to describe your day and wellness activities. By using this feature, you acknowledge and consent to the following:

• Your voice recordings are transmitted to OpenAI's API for transcription and analysis.
• AI analysis is used to extract wellness insights, detect mood patterns, and generate structured data from your spoken descriptions.
• Transcripts and AI-generated summaries are stored as part of your account data.
• You may choose to skip voice recording features at any time.

6. Apple HealthKit Integration

With your explicit permission, the App reads data from Apple HealthKit including exercise workouts, sleep analysis, and weight measurements. This data is used solely to populate your wellness dashboard and calculate weekly scores. We access HealthKit data in read-only mode and do not write data back to HealthKit. You can revoke HealthKit access at any time through your device's Settings > Privacy > Health.

7. Social Features

The App includes social features that allow you to connect with friends and family:

• Referral Codes: You may invite others to join using your unique referral code.
• Contact Lookup: With your permission, the App may check your phone contacts against our user database to help you find friends who also use Balance 7. Phone numbers are normalized and compared securely.
• Friend Wellness Status: Connected friends can see a high-level summary of each other's weekly wellness status. This feature is designed to encourage mutual support during high and low periods.
• You can remove friend connections at any time.

8. Data Storage & Security

Your data is stored locally on your device and synchronized to our cloud servers. We use industry-standard security measures to protect your data during transmission and storage. However, no method of electronic storage is 100% secure, and we cannot guarantee absolute security. Your password is stored using secure one-way hashing and is never stored in plain text.

9. Profile Photos

You may upload a profile photo from your device's photo library. Profile photos are stored as part of your account data and may be visible to connected friends. You represent that you have the right to use any photo you upload and that it does not violate any third party's rights.

10. Weekly Scoring System

The App generates weekly wellness scores across multiple dimensions including exercise, sleep, mood, voice wellness, nutrition, weight, inner child, reading, and screen time. These scores are calculated algorithmically based on your tracked activities and are intended as general wellness indicators. Scores are for informational and motivational purposes only.

11. Not Medical Advice

THE APP IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The wellness scores, insights, and recommendations provided by the App are for general informational and motivational purposes only. Always consult a qualified healthcare professional before making decisions about your health or wellness. Do not disregard professional medical advice or delay seeking treatment because of information obtained through the App. If you are experiencing a medical emergency, call your local emergency services immediately.

12. User Responsibilities

You agree to:

• Provide accurate and truthful information when using the App.
• Use the App only for its intended purpose of personal wellness tracking.
• Not attempt to access other users' accounts or data without authorization.
• Not use the App to distribute harmful, offensive, or illegal content.
• Maintain the security of your account credentials.
• Comply with all applicable laws and regulations.

13. Intellectual Property

The App, including its design, features, content, and underlying technology, is owned by Balance 7 Days and is protected by intellectual property laws. You retain ownership of the personal data you provide. By using the App, you grant us a limited license to process, store, and analyze your data solely for the purpose of providing and improving our services.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BALANCE 7 DAYS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID, IF ANY, FOR ACCESS TO THE APP IN THE TWELVE MONTHS PRECEDING THE CLAIM. The App is provided "as is" and "as available" without warranties of any kind, either express or implied.

15. Account Termination

You may delete your account at any time through the App's Profile settings. Upon deletion, all your data will be permanently removed from our servers. We reserve the right to suspend or terminate your account if we reasonably believe you have violated these Terms. We may also discontinue the App or any part of it at any time with reasonable notice.

16. Modifications to Terms

We may update these Terms from time to time. When we make material changes, we will notify you through the App and request your renewed acceptance before you can continue using our services. The version number and effective date at the top of this document indicate when these Terms were last updated. Your continued use of the App after accepting updated Terms constitutes your agreement to the revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved through binding arbitration in accordance with applicable arbitration rules, unless otherwise required by law.
